A Quick Refresher: What Are PFAS? 

PFAS, or per- and polyfluoroalkyl substances, are synthetic chemicals used in both industrial and consumer products since the 1940s. Known as “forever chemicals” due to their resistance to breaking down in the environment, PFAS have been used in everything from industrial processes to everyday household items like food packaging and nonstick cookware. 

Exposure to PFAS has been linked to a variety of health issues, including cancer, fertility issues, and immune system disruption. As discussed in our environmental due diligence podcast, the widespread use and persistence of PFAS is a key consideration during site assessments, and now a growing concern for stormwater discharges. 

Understanding New PFAS Requirements for Industrial Facilities 

Minnesota’s reissued Industrial Stormwater General Permit includes new requirements for PFAS monitoring and management. Facilities operating under certain Standard Industrial Classification (SIC) codes or narrative activities may be required to prepare a PFAS stormwater monitoring plan and collect samples for four consecutive quarters after receiving permit coverage. Facilities with a No-Exposure Exclusion, where all industrial activities and materials are fully sheltered from stormwater, are exempt. To determine your SIC code, visit OSHA’s SIC search tool.
